By accessing or using any services provided by GrowthFusionAI ("Company," "we," "us," or "our"), including our AI Assistant platform, website at growthfusionai.com, booking pages, and all related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
These Terms constitute a legally binding agreement between you ("Client," "you," or "your") and GrowthFusionAI. Completing any purchase, submitting a booking form, or using any part of our Services constitutes your acceptance of these Terms in full. We reserve the right to update these Terms at any time, and your continued use of the Services constitutes acceptance of any changes.
GrowthFusionAI provides AI-powered business automation services, including but not limited to: 24/7 AI Assistant for inbound call handling, smart appointment booking, lead capture and qualification, missed call text-back, omnichannel follow-up (phone, SMS, email, Instagram DMs, Facebook Messenger), call transcription and recording, call intelligence dashboards, CRM integrations, and Meta Lead Generation automation.
Services are provided on a subscription basis. A one-time setup fee covers the building, training, configuration, and deployment of your custom AI Assistant. Your AI Assistant is custom-built for your specific business and is live within 5 business days of your onboarding call. Features and inclusions are as described on our pricing page at the time of purchase.
To use our Services, you must: (a) be at least 18 years of age; (b) be a legal business entity or individual operating a legitimate business; (c) provide accurate, complete, and current information during registration and onboarding; and (d) maintain the security of any account credentials provided to you.
You are responsible for all activity that occurs in connection with your account and the use of your AI Assistant. You must notify us immediately of any unauthorised use or suspected security breach at [email protected].
Services are billed on a monthly subscription basis, processed via Stripe. By completing checkout, you authorise GrowthFusionAI and Stripe to charge your payment method for the applicable setup fee and recurring monthly subscription fee in accordance with the pricing displayed at checkout.
All fees are stated in Australian Dollars (AUD) unless otherwise specified and are exclusive of applicable taxes. You are responsible for all taxes associated with your use of the Services. Subscription fees are charged in advance for the upcoming billing period and are non-refundable except as expressly stated in our Refund, Cancellation & Billing Policy.
We reserve the right to change pricing with 30 days' written notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.
GrowthFusionAI offers a 30-day money-back guarantee on the one-time setup fee. If you are not satisfied with the Services within 30 calendar days of your payment date, you may request a full refund of the setup fee by contacting [email protected]. This guarantee applies to the setup fee only. Monthly subscription fees, prepaid usage credits, and any other charges are non-refundable. After 30 days, the setup fee is strictly non-refundable under all circumstances.
You may cancel your subscription at any time by emailing [email protected] with the subject line "Cancel Subscription." Cancellations must be submitted before your next renewal date to avoid being charged for the following billing period. Cancellation does not retroactively reverse any charges already processed.
GrowthFusionAI reserves the right to terminate or suspend your account immediately for violation of these Terms, fraudulent activity, initiation of improper chargebacks, or non-payment.

Our AI Assistant is powered by advanced language models and voice AI technology. While we strive for accuracy and performance, GrowthFusionAI does not guarantee that the AI will respond correctly in all situations or that it will capture every lead or booking without error. The AI is a tool to assist your business operations and should not be relied upon as a substitute for human judgment in critical matters.
You are responsible for reviewing AI interactions, call transcripts, and bookings to ensure accuracy. GrowthFusionAI is not liable for errors, missed bookings, miscommunications, or revenue loss resulting from AI responses or system limitations.
Your use of the Services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection, use, and sharing of data as described in our Privacy Policy.
You represent and warrant that you have obtained all necessary consents from your customers to record calls, capture personal data, and process that data through our platform, in compliance with all applicable laws including the Telephone Consumer Protection Act (TCPA), Australian Privacy Act 1988, GDPR, and any other applicable privacy or telecommunications legislation. GrowthFusionAI is not liable for your failure to comply with applicable consent requirements.
All intellectual property rights in the Services, including our AI models, software, dashboards, and branding, are owned by GrowthFusionAI. You are granted a limited, non-exclusive, non-transferable licence to use the Services during your active subscription period.
You retain ownership of all business data, scripts, and content you provide to us. By providing content, you grant us a licence to use it solely for the purpose of delivering and improving the Services.
By completing any payment to GrowthFusionAI, you expressly agree not to initiate chargebacks, payment disputes, or payment reversals with your bank, credit card issuer, or payment provider for any validly processed charge. A "validly processed charge" means any charge made in accordance with the pricing and terms you agreed to at checkout.
If you have a billing concern, you must contact GrowthFusionAI at [email protected] before initiating any dispute with your payment provider. In the event of an improper or fraudulent chargeback, GrowthFusionAI reserves the right to immediately suspend or terminate your account, recover all dispute fees and legal costs, and pursue legal or collection action to the fullest extent permitted by applicable law. You acknowledge that initiating a chargeback in violation of this clause constitutes a material breach of this agreement.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROWTHFUSIONAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE AT ALL TIMES.
These Terms are governed by the laws of Australia, without regard to conflict of law principles. Any disputes arising under these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved, disputes shall be submitted to binding arbitration or mediation in accordance with applicable Australian law, except that either party may seek injunctive relief in a court of competent jurisdiction.
